These Terms and Conditions govern the use of the online shop. fvcomponents.comfor which it is legally responsible ICIDE Energía, S.L.hereinafter referred to as "FV Components".. By accepting, the User declares that he/she has read, understands and comprehends what is set out herein and that he/she assumes all his/her obligations. If the User does not agree with the contents of this document, he/she must leave this website and may not access or use the services it offers. Likewise, the User expressly accepts, without exception, that access to and use of this website, its services and the contents of said services takes place under his/her sole and exclusive responsibility.

These Conditions shall be accepted by the parties without reservation, and may be modified at any time and without prior notice, it being the User's responsibility to read them when making a purchase or contract. The conditions in force at the time of conclusion of the contract shall be those applicable to you.

Applicable regulations

This electronic contract is concluded under Spanish law and specifically under the legal regime imposed by Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE) and by Law 03/2014, of 27 March, General Law for the Defence of Consumers and Users (LGDCU).

The electronic contract will not be archived by a third party and the language for its conclusion is English. The present general conditions can be stored and reproduced at any time by the user who makes a purchase through the options of his internet browser, and must be accepted before proceeding to the payment of the order.

User Account and Error Correction

In order to be able to make online purchases in this shop it is necessary to register by creating a "User Account". You can register at any time by clicking on the corresponding link, or during the purchase process. Once registered, you will receive an email confirming that the process has been completed successfully and a reminder of your login details.

From your account you will be able to make purchases, check your order history, change your password, modify your personal details, modify your delivery and billing addresses, make comments, and other procedures or formalities related to your purchases.

In addition, at any time, you may access your private account to check personal information and addresses and, if necessary, correct any errors that may have occurred in the entry of the data or update the same. Shipping and billing addresses may also be corrected or updated during the checkout process.

As a User, you may unsubscribe at any time by sending an e-mail from the address you wish to unsubscribe to [email protected], which will lead to the cancellation of your personal data.

In any case, the creation and cancellation of a user account shall be governed by the provisions of the Privacy Policy.

Purchasing Process

Buying at "FV Componentes" is easy and simple, just follow the steps below:

1º.- Select the products you wish to purchase from among those offered by "FV Componentes". By clicking on each product, you will access its data sheet, which includes a detailed description with information, main features and price. If you need more information, do not hesitate to ask us. NOTE: In the case of product files with photographs, the products may suffer slight variations in colour or texture with respect to the photograph that appears on the website, due to different factors, for example, the resolution of your monitor. However, we will do our best to ensure that the images are as true to life as possible.

2º.- Once you have selected the product(s) you wish to buy, click on the "Add to cart" button, and the product will be added to your shopping cart. If you wish, you can continue adding more products to the cart, or proceed directly to checkout.

3º.- Once the product selection has been completed, a summary will appear identifying the item(s) selected. Finally, to continue with your order, you must click on the "Place order" button.

4º.- As we have indicated in previous sections, at the end of your purchase, you must register, indicating your contact details and address. In your next purchases you will not have to enter your details again, as they will be stored in your User Account.

5º.- Finally, you must accept these Conditions of Sale and choose the method of payment from among those offered by "FV Componentes" (see next section).

6º.- Once the purchase process has been completed, we will send you an email with the details of the purchase, as well as proof of purchase or invoice in digital format. If you do not receive this email within 24 hours, or if you notice any error in the data entered, please contact us by any of the following means:

Methods of payment

"FV Componentes" offers different payment methods:

Below, we specify the conditions for each of these payment methods.

Bank transfer

"FV Componentes" offers you the possibility to pay for your order by bank transfer to our bank account:

If you choose this payment option, once you have completed your order, the details required to make the bank transfer will appear on the screen. In addition, we will send you an email with the amount of the order, the concept that you must indicate and the account number. It is important that, at the time of making the transfer, you indicate as a concept the reference of your order, provided by "FV Componentes" in the email, to expedite the billing and shipment of the order.

Transfers can take up to 48 hours to become effective, please take this into account in the delivery times. Once payment has been confirmed, the order will be invoiced, packed and shipped. If you wish to speed up this process you can send us an email with the receipt to [email protected].

Credit or debit card

Payment by credit or debit card is made through Bankinter's secure payment gateway. Through this payment method, "FV Componentes" never collects or manipulates any customer data relating to your card number. All data is processed directly by Bankinter, so that "FV Componentes" can always offer the greatest security, transparency and confidentiality in the transaction.

Paypal

Make the payment with your PayPal account. Using this payment method, "FV Componentes" never collects or manipulates any bank details. All data is processed directly by Paypal, so that "FV Componentes" can always offer the greatest transparency, security and confidentiality in the transaction.

Financing with Cetelem

"FV Componentes" offers you the option of financing your purchase through the credit bank Cetelem. This offer is subject to the prior authorisation of Banco Cetelem S.A.U. after studying the documentation provided and signing the contract. More information here.

Terms and conditions of shipment

Deliveries will be made to:

  • Peninsular Spain
  • Balearic Islands
  • Germany, Austria, France, Italy and Portugal

The shipment will always be sent by road or ship (Economy) with the delivery times corresponding to this service (between 2-4 working days).

The carriage shall be free on orders over

  • 300€ on mainland Spain
  • 500 in the Balearic Islands, 
  • 1000€ Germany, Austria, France, Italy, Portugal

In all other cases, the carriage charge shall be:

  • Mainland Spain: 4,5€.
  • Balearic Islands: 9,5€.
  • Germany: €25
  • Austria: 28
  • France: €25
  • Italy: €30
  • Portugal: 20€.
We do not ship to Canary Islands. We offer the possibility of collection in shop with your means for these cases, being the sale with the taxes corresponding to a sale in peninsula.

The transport company usually delivers during business hours, so if you have a delivery time preference, you can indicate it in the order comment and we will try to comply with it (within the possibilities of the route and timetable of the transport company).

Delivery deadlines

FV Componentes has stock of the references with the highest turnover, however our catalogue is so wide and economical because in many of the references offered, we work to order. This means that the delivery time can be extended to 1-3 weeks + subsequent shipment by the transport agency, depending on the manufacturer's own stock breakage or its associated distributor. This allows us to offer competitive and attractive prices to the customer.

For the deadlines indicated by the transport agencies during the sales process, the customer accepts that these are estimated deadlines according to the general conditions of transport and that these do not constitute a contract of sale, and may be extended without the possibility to impute to FVComponentes.com any responsibility in the delay of such delivery by the transport company. However, our sales team will ensure that the delivery is as fast as possible and will mediate between the carrier and the customer in the event of any delay in delivery. In the event that the customer has indicated his address with errors or wishes to make changes, he should contact the transport company directly to indicate these changes.

In the event of non-compliance with delivery deadlines, you must give us an additional period of time that is appropriate to the circumstances that caused the initial delay. If we are also unable to deliver the goods within this additional period, you may terminate the contract. If the delivery period is essential in view of all the circumstances surrounding the conclusion of the contract or if you have informed us before the purchase that delivery before or on a certain date is essential. In such cases, you may terminate the contract immediately.

In any case, in the event of termination of the contract, the amounts paid shall be reimbursed in full.

In the event that the User purchases a product that has not yet been released for sale, but which already has a release date, the delivery times will be provisional and modifiable, and will be subject to the number of units per product that the suppliers have available at any given time. In this case, we will contact you to inform you of the variations in these products, as well as the possibility of cancelling the contract.

In some cases, a stock shortage may occur. In this case, the customer can contact our staff to provide a solution and to inform you of the delivery time once the selected product is available, or to terminate the contract if you wish to do so.

IMPORTANT: In general, we are not responsible for the non-fulfilment or delay of obligations due to causes beyond our control, such as force majeure (confinement due to a state of alarm, for example), natural catastrophes, strikes, accidents, etc. Should any incident arise, we will contact you to resolve the incident.

Prices, taxes, fees and duties

Prices are expressed in Euros. The prices of "FV Componentes" products may vary, but any changes will not affect orders for which a Shipping Confirmation has already been sent.

The final price of the products purchased may vary according to the taxes applicable in each case, or depending on the shipping address and profile of the buyer (individual or professional). For information purposes, except in those activities not subject to or exempt from VAT, the following taxes will apply to the items on our website:

  • The RRP of the articles with shipping address to the Peninsula and Balearic Islands includes VAT in any case.
  • The RRP for items with delivery address to other EU countries, and the buyer being a natural person (private individual) includes VAT.
  • The RRP of the articles with shipping address to other EU countries, and being the buyer a company or professional, does NOT include VAT as long as it is registered in the Register of Intra-Community Operators (in which case we will have to provide the valid Tax Identification Code). In the case of not being registered as an I.O., the PVP includes VAT.

Account and service deletion, cancellation and blocking

User accounts are not deleted for lack of use. Users can unsubscribe by requesting it to the staff of "FV Componentes", by sending an email to [email protected] or through their account profile.

In the event of non-payment of an order, this may be temporarily suspended until the non-payment situation has been resolved by the user. If more than 15 days have elapsed, "FV Componentes" may proceed to cancel the order.

"FV Componentes" reserves the right to block access to the User's account without prior notice (or directly delete the User's account), if the User uses it in an illegal manner or breaches the obligations and rules established herein, which will be communicated by e-mail. The blocking or deletion of the User account shall have no effect on the obligation to pay for the products purchased, if applicable.

In exceptional cases, at the discretion of the administrators of "FV Componentes", and evaluating the seriousness of the offence, the administrators may choose to warn the offending user before deleting or blocking their account definitively.

By registering as a User, you agree that the owners of this site reserve the right, and may act at any time and without notice, to modify or discontinue this website and its services, or to remove data provided, either temporarily or permanently.

Returns

At "FV Componentes" we want you to be satisfied with your order. Therefore, we provide you with several methods to return an item that may not meet your needs or expectations.

MANDATORY STANDARDS FOR PACKAGING AND PROTECTION OF RETURNED GOODS:

Products must be returned in a manner that protects them, including the original product packaging, by sending them inside a rigid cardboard box that sufficiently protects the original product packagingIf the packaging of the product itself is damaged during transport (even if this damage is slight or superficial), the return will not be accepted because it was sent in inadequate packaging. THE FOLLOWING PACKAGING SHALL NOT BE ACCEPTEDPlastic bags, wrapping paper or any other cover, wrapping or packaging that does not "mechanically" protect the original packaging of the product against knocks or dents. Therefore, in the event of receiving the return in these conditions, this return will be automatically rejected. FVComponentes.com provides the buyer with a transport company for the collection of the goods.

Possible cases of return or withdrawal:

1. The product is wrong, has a defect or has been damaged during transport:

We take great care to ensure that all our deliveries are made correctly. If, even so, you receive an incorrect item, please contact us as soon as possible to solve it. Before opening the product, check that the packaging matches the one you ordered: colour, size, finish, etc.

For its part, if the products received present any defect or deterioration, we will respond to the lack of conformity as set out in the section "Warranties" within these conditions of sale.

If the product has been damaged during transport it is necessary that you inform us and, if possible, note the incident on the delivery note of the carrier. 

2. Withdrawal:

We don't want you to keep anything you don't like, so you can return an item if it doesn't meet your expectations. Therefore, in accordance with the provisions of the LGDCU, and provided that you are a purchaser of an item for private use, you have the Right of Withdrawal, by virtue of which you can return the product, provided that it is not a digital product for which the download has been initiated.

The exercise of this right of withdrawal must be made within a reasonable period of time. maximum period of FOURTEEN (14) days from the date of purchase. You must notify us by email at [email protected] of your decision to withdraw from the purchase and wait for our reply with instructions on how to correctly identify your return.

In order to exercise this right, the product must be in perfect condition, and retain the original packaging, as well as all the parts. In the event that the products do not arrive in perfect condition, do not include all parts and accessories, or do not retain their original packaging, "FV Componentes" reserves the right to refuse the return or to pay a lower amount for the return, and you will be notified of this circumstance.

The refund of the purchase price will be made once the condition of the goods has been checked, through the same means of payment used for the purchase and, in any case, within 14 calendar days of the reliable receipt of the cancellation request, as long as it is "FV Componentes" who manages the collection of the article. In the event that you return the article via a transport company of your choice, the period of 14 days will begin to run from when "FV Componentes" has actual knowledge of the dispatch of the goods or, failing that, from the receipt of the same.

The return costs arising from the exercise of the right of withdrawal shall be borne by the purchaser, offering the customer the possibility of us arranging collection (only in Spain) under the following conditions;

Cost of the equipment < 1000€ (VAT included) Spain = A transport fee of €12.1 (incl. VAT) is established for the collection or return of the equipment to be returned to the customer (from the customer's address or to the customer's address) per item of equipment to be returned and per journey within Spanish territory.

Cost of equipment > 1000€. (tax incl.) Spain = A fee is charged for the cost of collection or return transport to the customer (from the customer's home or to the customer's home).  from 24,2€ (incl. VAT) per equipment to be returned and journey in Spanish territory.

If, upon receipt of the item, it shows damage, marks of use or the packaging is not in perfect condition, the customer will be notified of this circumstance as a reason for rejection and will be offered the return of the item with the same costs mentioned above in the collection of the item.

SPECIAL PRODUCTS 110V-120V

The equipment with a voltage output of 110V-120V are considered special and their supply will be made to order, so the delivery time may be slightly extended. On the other hand, these orders, as they require additional management by distribution, will be subject to a surcharge of €35 vat included in the event of cancellation. The customer declares to be aware of this circumstance and accepts it.

If you have not yet received your order and you wish to cancel or modify it, you only have to inform us of the changes you wish to make, without any cost in case your order has not yet been processed.

Guarantees

Victron Energy offers a 5 year standard warranty on all its batteries: we offer a 2 year warranty on lead-acid batteries and a 3 year warranty on Victron branded lithium batteries.

For the rest, except those which, by their nature, are excluded from the consumer goods warranty regulations, and provided that the purchaser makes a particular use, all our products are guaranteed at a national level, against manufacturing defects during three years from the date of purchase (or date of delivery, if later), or one year if the item is not new.

We shall be liable for any lack of conformity, which the purchaser must inform us of within two months of becoming aware of it.

If the defect or lack of conformity arises within the first 2 years of delivery of the item, it is presumed that the defect or lack of conformity already existed when the product was invoiced (or delivered, if at a later point in time), i.e. that there is an original or manufacturing defect in the product, unless we can prove that the defect or lack of conformity is not original, but is due to, for example, misuse or poor maintenance by the buyer.

On the other hand, if the defect or lack of conformity arises after 2 years, the presumption that the defect is ex-factory does not exist.

In the event of a defective product, we may proceed, as appropriate, to repair, replace, reduce the price or terminate the contract. These actions will be completely free of charge for the purchaser (including transport costs, if any). in the event that the item eventually develops a problem covered by the manufacturer's warranty after overhaul by the brand's official service. 

OVERHAUL OF COMPONENTS IN GOOD CONDITION OR PROBLEM NOT COVERED BY MANUFACTURER'S WARRANTY:

If after the review by the official service of the brand, it is determined that the equipment does not present any damage, fault or problem, or this is due to elements or factors external to the product, the customer shall bear the costs of shipping/return of said article plus the costs of review and laboratory tests carried out by the manufacturer.

The established scale for shipping/return costs plus laboratory tests to be borne by the customer in case the equipment is finally in good condition or the damage is not covered by the manufacturer's warranty will be as follows:

Equipment cost < 300€. (vat included) = There is a single transport charge for pick-up (from the customer's home) and return (to the customer's home) of 15 (incl. VAT) per item of equipment to be serviced, plus a manufacturer's fee for servicing each item of equipment shipped in good working order or with a problem not covered by the manufacturer's warranty, of 20€ (incl. VAT). Adding up to a total of 35€ per item. On these items, customers will be charged a deposit for handling / processing costs of €35 which will be refunded once it is concluded that the equipment has a problem covered by the manufacturer's warranty.

Equipment cost 300€ > 1000€ (vat included) = There is a single transport charge for pick-up (from the customer's home) and return (to the customer's home) of 18€ (incl. VAT) per item of equipment to be serviced, plus a manufacturer's fee for servicing each item of equipment shipped in good working order or with a problem not covered by the manufacturer's warranty, of 35€ (incl. VAT). Adding up to a total of 53€ per item.

Cost of equipment > 1000€. (vat included) = There is a single transport charge for pick-up (from the customer's home) and return (to the customer's home) of 35€ (incl. VAT) per item of equipment to be serviced, plus a manufacturer's fee for servicing each item of equipment shipped in good working order or with a problem not covered by the manufacturer's warranty, of 65€ (incl. VAT). Adding up to a total of €100 per item.

Defects and deterioration caused by external events, accidents, use not in accordance with our instructions or those of the manufacturer (incorrect use) or normal wear and tear are therefore excluded from the guarantee. Also, products that have been modified or repaired by the customer or any other person not authorised by "FV Componentes", as well as products that are the subject of a specific contract. In such cases the consumer shall be responsible for their repair.

By regulation, and in the absence of proof to the contrary, the products shall be deemed to be in conformity with the contract provided that they meet all the requirements set out below:

  1. a) Conforms to the description given and possesses the qualities of the product which we have presented to the consumer and user in the form of a sample or model.
  2. (b) are fit for the uses for which similar products are normally intended.
  3. (c) they are of a quality and performance which is normal for a product of the same type and which the consumer and user can reasonably expect, given the nature of the product.

Conflict resolution

As required by the new European regulations, we inform users of the existence of a European dispute resolution platform for online contracting. Thus, for the reconsumer dispute resolution (under Art. 14.1 of Regulation (EU) 524/2013), the European Commission provides an online dispute resolution platform which is available at the following link: https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=ES
